Injury 'Caps' on personal injury claims, lawsuits and settlements in Nova Scotia

In 2003, the Nova Scotia government imposed a cap of $2,500 on some "general damage" awards in motor vehicle collision personal injury claims, lawsuits and settlements
The 'cap' legislation does have the potential to impact upon a motor vehicle collision personal injury claim, where the injuries come within the legislation's definition of "minor".
However, the amount of the final personal injury settlement comes from a variety of factors, including future care costs, loss of income and loss of housekeeping capacity. These are areas outside of the general damages claim for pain and suffering and therefore are not affected by the 'cap' legislation.
The impact the 'cap' legislation will have on your personal injury claim and damage settlement depends on many factors and likely will have minimal effect on those who have suffered catastrophic injuries like loss of limb, multiple fractures, or brain injury.
The Chronicle Herald reported (2008-02-12) that a Calgary court case could be the death knell for Nova Scotia's $2500 cap on minor injury awards in auto accidents. New Democrat MLA Graham Steele said that although the Alberta government may appeal the decision that declared that provinces $4,000 cap unconstitutional, the MacDonald government here should act on it.
